Generally, these may include prior title deeds, sale/conveyance documents, property card/7-12 extracts or other applicable revenue records, mutation entries, search/registration records, tax records, sanctioned plans, development documents, succession documents, mortgage documents and relevant NOCs/permissions.
The timeline depends on the property's location, complexity of the title chain, number of documents, availability of records, age of the transaction, number of owners, succession issues and the scope of investigation. A specific turnaround time can be agreed after reviewing the assignment.
The issue is documented in the legal due-diligence report. Where appropriate, we may identify the nature of the defect, supporting documents required, corrective action, conditions precedent and other steps that may be considered before accepting the property/security, subject to the client's decision and applicable law.
No absolute guarantee can be given merely on the basis of documents or searches. A legal opinion is based on the documents, records, searches and information available at the time of investigation and the agreed scope of work.
Yes. The scope can be structured specifically for lender/NBFC security acceptance, including title investigation, ownership verification, encumbrance review, mortgage/security analysis, document deficiencies, risk identification and conditions precedent.
Yes. A monthly/annual legal retainer arrangement can be considered for NBFCs, financial institutions, corporates and other organisations requiring continuing legal support. The scope, turnaround time and professional fees can be agreed separately.
Unless specifically agreed otherwise, government fees, stamp duty, registration fees, search fees, CERSAI-related charges, court fees, advocate/appearance expenses and other third-party expenses are separate from professional fees.
Generally, yes. Title verification, documentation, legal opinions, NOI and due-diligence assignments can be priced according to the assignment, while litigation and court-related work may be charged separately based on the nature, forum, complexity and stage of proceedings.
Documents and information provided for an assignment are handled in accordance with applicable professional obligations and the terms agreed with the client. Appropriate confidentiality/NDA arrangements may also be incorporated where required.
The client can provide the basic transaction/property details and available documents. After an initial review, the scope, deliverables, timeline, professional fees and any specific conditions can be confirmed before commencement.
